Licensing and Legislation

In order to operate within the territory of Romania, land-based and online operators that offer games of chance, sports betting odds, and other forms of gambling to consumers, need to apply for a Class 1 licence. Apart from earning a licence, operators are also required to apply for and obtain authorisation for the gambling products they provide.

In order to be eligible for a licence, an operator must be based within the European Union, the EEA, or the Swiss Confederation. Furthermore, international remote gambling websites need to set up servers in Romania that can be monitored by the National Gambling Office, and operators also need to obtain certification that their products and IT system have been inspected by a Class 2-licensed laboratory.

Class 1 licences have a validation period of 10 years, with the condition that the operator in question can pay all fees related to running a gambling business within Romania. As for authorisation, it needs to be renewed each year.

The only casinos and sportsbooks that are legally allowed to target and cater to Romanian gamblers are those that have obtained a valid Romanian licence and the necessary authorisation. Unlicensed websites with no authorisation are forbidden from accepting Romanian players. Taxes

It should be noted, however, that in August 2022, the Romanian government approved a bill that will increase taxes pertaining to gambling. Starting January first, 2023, the annual Class 1 licensing fee for onlines gambling businesses will be between €15,600 and €312,000. The Authorisation tax will go from 16% to 23% of the annual GGR of a remote operator. Player fees are also addressed in the bill, and individuals with winnings of up to €2,000 and €13,600 will be charged 6% and 20%, respectively. The maximum tax imposed on withdrawals of over €13,600 will go from 25% to 40%.
